By accessing or using the EvenPath website (evenpathhomes.com), you agree to these Terms of Service. If you do not agree, please do not use our website.
About EvenPath
EvenPath LLC is a real estate investment company that purchases residential properties in Tucson, Arizona and surrounding areas. We are NOT a licensed real estate brokerage. We buy properties as a principal buyer for our own investment purposes or for our network of investors.
When we refer you to a licensed real estate agent for a traditional market sale, we are making a referral to an affiliated business partner, not acting as your agent. See our Affiliated Business Arrangement Disclosure for details.
EvenPath Protected Parties
For these Terms, the "EvenPath Protected Parties" means: (a) EvenPath LLC; (b) its current and future direct and indirect parents, parent companies, holding companies, subsidiaries, affiliates, sister entities, entities under common control, and any other related entity that EvenPath LLC owns, controls, manages, creates, or acquires now or in the future; and (c) the respective past, present, and future owners, beneficial owners, members, managers, directors, officers, employees, agents, representatives, contractors, insurers, attorneys, successors, and assigns of all of the foregoing entities.

No Guaranteed Outcomes
While we strive to provide cash offers within 24 hours and close quickly, actual timelines depend on title clearance, lien resolution, court approvals (if applicable), and other factors specific to your property and situation. All offers are subject to property verification.

Lead Data Sharing and Communications Consent
By submitting a form through our website, you direct and authorize EvenPath LLC and the EvenPath Protected Parties to collect, analyze, store, use, and disclose the general lead information you provide about yourself and your property, including your name, phone number for calling, email address, property address, property details, selling timeline, and interaction with the website, to independent buyers, investors, wholesalers, brokers, licensed agents, service providers, CRM platforms, call centers, business partners, and other commercial counterparties that may evaluate your property or help facilitate a potential transaction.
You also agree that EvenPath LLC, the EvenPath Protected Parties, and the independent third parties described above may contact you by phone (including calls made using an automatic telephone dialing system, prerecorded voice, or artificial voice), email, and mail at the phone number, email address, and property address you provide, regarding your property inquiry or related real estate services. This consent applies even if your number is on a state or federal Do Not Call list. Consent is not a condition of any purchase or service. SMS Messaging Program
EvenPath LLC is an Arizona-based real estate investment company that purchases residential properties directly from homeowners. If you opt in to receive text messages, you may receive text messages related to property purchase inquiries, appointment reminders, offer updates, and other transaction-related communications. If you separately opt in to marketing texts, you may also receive promotional messages about special offers, promotions, and service updates.
You can cancel the SMS service at any time by texting STOP to our number. After you send the SMS message STOP, we will send you a confirmation text that you have been unsubscribed. After that, you will no longer receive SMS messages from us unless you opt in again later.

Independent Third Parties; No Agency
Any buyer, investor, wholesaler, agent, broker, vendor, call center, platform, or counterparty that receives your information is an independent business and is not an agent, joint venturer, franchisee, employee, or representative of any EvenPath Protected Party unless the applicable entity expressly agrees otherwise in a separate signed writing. No EvenPath Protected Party controls or assumes responsibility for the acts, omissions, advertisements, representations, offers, negotiations, communications, telemarketing practices, compliance procedures, licensure, or services of those independent third parties.
Release, Waiver, and Hold Harmless
To the fullest extent permitted by law, you release, waive, and agree to hold harmless the EvenPath Protected Parties from and against any claims, demands, damages, losses, costs, expenses, or liabilities arising out of or relating to the acts, omissions, contacts, communications, offers, negotiations, or services of any independent third party after your information has been shared, except to the extent a non-waivable violation of law, fraud, or willful misconduct of an EvenPath Protected Party is finally determined by a court or arbitrator of competent jurisdiction.
Limitation of Liability
To the fullest extent permitted by law, no EvenPath Protected Party will be liable for any indirect, incidental, special, consequential, exemplary, punitive, or statutory damages arising out of or relating to the website, your submission of information, any third-party contact, or any transaction or attempted transaction. The total aggregate liability of all EvenPath Protected Parties for any claim relating to the website will not exceed one hundred dollars ($100) or the amount you paid directly to EvenPath LLC for use of the website, whichever is greater.
⚠️ Mandatory Individual Arbitration; Jury and Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.
To the fullest extent permitted by law, any dispute, claim, or controversy arising out of or relating to the website, your submission of information, any communication initiated by or on behalf of EvenPath LLC or any EvenPath Protected Party, the disclosure of your information to independent third parties, or these Terms, including any claim under the TCPA, TSR, do-not-call laws, privacy laws, unfair competition laws, or similar statutes, will be resolved exclusively by final and binding arbitration on an individual basis and not in court, except that either party may bring an eligible individual claim in small claims court.
You and each EvenPath Protected Party waive any right to a jury trial and any right to participate in a class action, class arbitration, private attorney general action, or other representative proceeding. Each EvenPath Protected Party is an express third-party beneficiary of this arbitration provision and may independently enforce it.
Nothing in this section prevents either party from seeking injunctive relief, specific performance, or other equitable remedies in a court of competent jurisdiction where such relief is necessary to prevent irreparable harm.
By submitting a form on our website, you acknowledge that you have read and agree to this arbitration provision.
No Recourse Against the Corporate Chain
The contractual obligations under these Terms are solely those of EvenPath LLC. To the fullest extent permitted by law, you agree that you will have no recourse against any parent company, holding company, subsidiary, affiliate, related entity, or any owner, beneficial owner, member, manager, director, officer, employee, agent, representative, successor, or assign of any of them solely by reason of that status or corporate relationship.
Governing Law
These Terms of Service are governed by the laws of the State of Arizona, subject to the mandatory arbitration provision above.
